General terms and conditions for digital products
These general terms and conditions apply to all offers and orders for digital products offered for sale on wijntjens.nl. Using an offer or placing an order (i.e. downloading free or paid products) via the eShop of wijntjens.nl means that you accept these general terms and conditions of sale.

1 Offers, prices and payments
1.1 The prices stated for the products and services offered are in euros and include 21% VAT.
1.3 Payment for the digital products offered on wijntjens.nl is made online and via the payment methods offered. The product is delivered digitally and automatically via email after successful payment.
1.4 By placing an order and paying for a digital product, the buyer enters into a definitive purchase agreement with wijntjens.nl. The terms and conditions of this agreement are available on wijntjens.nl before and at the time you order a product. You must also accept these terms and conditions during the ordering process.
1.5 A final agreement gives the buyer the non-exclusive and non-transferable right to use the digital products. The intellectual property rights and legal copyright remain with wijntjens.nl at all times.
2 Intellectual property rights
2.1 All intellectual property rights concerning digital products, both in their entirety and in parts, remain the property of wijntjens.nl. You undertake to refrain from any action that infringes on the intellectual property rights.
2.2 wijntjens.nl guarantees that the digital products delivered to you do not infringe on any intellectual property rights of third parties.
3 Liability and responsibility
3.1 wijntjens.nl is not liable for damage that may result from the use of the products in question.
3.2 Correspondence and/or delivery takes place via email and the internet. You are responsible for providing the correct (email) address to wijntjens.nl. In addition, you are also responsible for the correct configuration of your PC and any programs such as firewalls, spam filters and virus scanners, so that messages and digital products sent to you can be received.
4 Copyright and prohibited use of downloads
4.1 The digital products of wijntjens.nl are copyrighted. It is therefore not permitted to copy and/or distribute and/or commercially exploit the purchased digital products.
4.2 It is not permitted to create “derivative works” by modifying the downloads and then distributing or commercially exploiting them.
5 Cancelling an order
5.1 There is no right of return on digital products of wijntjens.nl. Cancelling an order that has already been executed and delivered is therefore not possible.
6 Miscellaneous
6.1 If one or more of the provisions of these Terms and Conditions conflict with any applicable law, the provision in question will lapse and will be replaced by a new comparable provision to be determined by wijntjens.nl.
6.2 These terms and conditions are exclusively governed by Dutch law.
6.3 All disputes between parties will be submitted exclusively to a competent court in the Netherlands.

7.1 The customer can only (re)download a title from his own IP address or one other IP address.
7.2 There is a maximum number of times a customer can download a paid audio file.
7.3 There is a limited period that a customer can download a paid audio file again after the first download.
7.4 If the customer wishes to re-download a downloaded title, for example after a system crash, and the download is no longer available due to point 7.1, 7.2 or 7.3 above, the customer service of wijntjens.nl can re-release the download upon request.
7.5 There are no DRM restrictions, after downloading the audio files can be used without any restrictions.
7.6 There are no DRM restrictions, the downloaded files can be played on any MP3 player and any computer that is capable of displaying MP3 files.
7.7 There are no DRM restrictions, it is permitted to download for personal use, to copy and/or burn to CD.
7.8 Each download from wijntjens.nl is uniquely personalised and contains information about the customer, making abuse traceable.
